    • Seek injunctive relief to prevent further unauthorised use or distribution.

Key Elements and Why They Are Included (For your research):

  • Clear Statement of Ownership: Establishes who owns the intellectual property from the outset.

  • Limited License: Defines exactly what the user is allowed to do (personal, non-commercial use), which then highlights what they aren't allowed to do.

  • Explicit Prohibitions: Directly addresses the "no teaching" aspect and other forms of unauthorised use (reproduction, distribution, etc.). The language is strong ("expressly agree and covenant," "strictly prohibited").

  • "Without Explicit Prior Written Consent": This is crucial. It allows you to grant permission under specific circumstances if you choose, but maintains control.

  • Acknowledgement of Harm: Strengthens the case for injunctive relief (stopping the activity) because it states monetary damages aren't enough.

  • Consequences of Breach: Clearly outlines what happens if the terms are violated, providing a deterrent and a basis for action.

  • Affirmative Acceptance: Emphasises that the user actively agrees (e.g., by clicking a button), which is important for enforceability of online agreements.

  • UK Law & Jurisdiction: Specifies that UK law applies and UK courts have jurisdiction, which is vital for any legal action.
